AI Use Disclosure — MONKEY MASTERING

This document transparently describes the algorithmic nature of the MONKEY MASTERING software, for the purposes of Regulation (EU) 2024/1689 (EU AI Act), the GDPR (Art. 22 on automated decisions), and the general principle of transparency toward users.

1. Technical nature of the Software

MONKEY MASTERING performs audio analysis and mastering through deterministic Digital Signal Processing (DSP) algorithms with preconfigured parameters. Specifically:

FFT / STFT (Fast / Short-Time Fourier Transform) for spectral analysis.
HPSS (Harmonic-Percussive Source Separation) to decompose content into harmonic and percussive components.
Wiener filtering and classical spectral masking for cleanup / enhancement.
Biquad filters (parametric, shelving, high/low-pass) for equalization.
Classical spectral heuristics and empirical rules for tonality detection, tonal balance, and dynamics.

These algorithms are deterministic: for the same input and parameters, the output is identical.

2. What the Software does NOT do

It does NOT use trained machine-learning models (neural networks, deep learning, statistical models trained on corpora) in the audio processing chain.
It does NOT train any model on User audio or User data. Neither the Licensor nor any third party uses User material to train models of any kind.
It does NOT perform cloud audio processing. All DSP runs locally on the User's device.
It does NOT perform automated profiling of the User within the meaning of Art. 22 GDPR, nor make decisions with legal or significant effects based on personal data.
It does NOT produce generative outputs (synthetic audio, cloned voices, content created from scratch). It only transforms the audio the User supplies.

3. Fit with Regulation (EU) 2024/1689 (EU AI Act)

The Software is not an "AI system" within the meaning of Art. 3.1 of the AI Act, as it lacks a trained model with adaptive inferential capacity. In technical terms, it is a classical parameterized DSP.
Even under an extensive interpretation, the Software does not fall within the unacceptable-risk categories (Art. 5) nor the high-risk categories (Art. 6 and Annex III): it is not used for biometrics, employment, credit, justice, migration, education, or critical infrastructure.
The Software has no registration obligations in the EU AI systems database and requires no AI CE marking.
Transparency (Art. 50 AI Act): does not strictly apply (the Software is not an AI system), but the Licensor publishes this Disclosure as a voluntary best practice of transparency.

4. Future evolution

If machine-learning components are added in the future (e.g. a pre-trained model for preset suggestions, genre detection, etc.), the Licensor will:

Update this document detailing the model used, its purpose, and whether it was trained on User data.
Revise the Privacy Policy to reflect any additional processing.
Assess fit with the AI Act and comply with applicable obligations (transparency, technical documentation, human oversight, conformity assessment, etc.).
Under no circumstances will User audio be processed in the cloud without the User's explicit consent.

6. Language versions

This document is published in Spanish and in other languages to make it easier to understand. The Spanish version is the only authentic one: in the event of any discrepancy between versions, the Spanish text prevails.

This preference does not deprive the consumer of the rights granted by the law of their country of habitual residence, in accordance with Article 6 of Regulation (EU) 593/2008 (Rome I).
